Scope
These General Terms and Conditions of Business apply to all orders and deliveries between Roland Rabi EV (5700, Gyula, Szőlős u. 14./B, Hungary, hereinafter: Barbaral Creations) and its customers via the online shop www.barbaralcreations.eu.
Order process, entering into a contract
- Order process
By clicking on the products or product descriptions, the customer navigates to the product details, .e.g. details regarding the product design, size, etc. The product is placed in the virtual shopping basket by entering the requested quantity and clicking on the shopping basket icon.
By clicking on the "shopping basket" button, displayed in the top right-hand corner of the online shop, the customer navigates to an overview page and at any time can check the goods in the virtual shopping basket and, where necessary, make changes.
If a customer does not wish to purchase additional goods, they can continue via the "To order/checkout" button. Registered customers can enter their user names and passwords here to automatically use their saved information for the order. Alternatively, the customer can register as a new customer and set up a customer account or continue the purchase without setting up a customer account. In such a case, the customer must enter their address and invoice information on the following page.
The order is entered into by clicking on the "CONFIRM ORDER" button. This means a binding offer has been made.
- Entering into a contract
The images of the range in the online shop are intended as an illustration and do not constitute binding offers for sale. By completing the order process by clicking on the "CONFIRM ORDER" button the customer makes a binding offer to enter into a purchase contract. The customer thereupon receives an automated confirmation of receipt of order by e-mail (order confirmation). This order confirmation does not constitute acceptance of the offer. The contract with Barbaral Creations is only concluded when Barbaral Creations sends the ordered product to the customer and the shipping to the customer is confirmed by e-mail (shipping confirmation).
Prices and shipping charges

All prices contain the statutory VAT and other price elements, and are to be understood plus shipping costs that may apply. We do not sell to businesses so we do not issue VAT receipts, nor do we refund the VAT.

Dispatch and delivery
Unless stated otherwise in the offer, the delivery period is 3 to 5 working days after dispatch. Information about delivery and shipping conditions is available here.
Deliveries are free of customs duties within the EU. In the case of delivery in countries outside the EU customs duties, taxes and other levies that may apply shall be borne by the customer.
In the event that supplied products are damaged en route, the Barbaral Creations customer service is to be contacted, where possible, without delay. As a result, Barbaral Creations shall have the option of lodging a complaint with the carrier or transport insurer regarding the damage. If the customer fails to provide notification of transport damage, this shall not have any effect whatsoever on the customer's statutory guarantee rights.
Retention of title
The goods shall remain the property of Barbaral Creations up until payment in full. Prior to the passing of ownership, pledging, ownership transfer by way of security, processing or redesigning are not permitted without approval by Barbaral Creations.
Right of withdrawal
Customers who are consumers have a fourteen-day cancellation right. A consumer is any natural person who enters into a legal transaction for a purpose that is neither attributable to their commercial nor self-employed professional activity. The following regulations apply to the cancellation right and the excluding of the cancellation right. If customers have any further questions about cancellations, they can contact the Barbaral Creations customer service.
- The exercise of the right of withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you, acquires, physical possession of the goods.
To exercise the right of withdrawal, you must inform us of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or e-mail). You may use the online model withdrawal form (can be found on the bottom of this page) but it is not obligatory.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

If you withdraw from this contract, we shall reimburse to you all payments received from you, without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
You shall send back the goods to:

The deadline is met if you send back the goods before the period of 14 days has expired.
- Exclusion of the right of withdrawal
The right of withdrawal does not apply in the event of delivery of goods:
• that are not pre-produced and an individual selection or determination by the consumer is authoritative for their manufacture or goods that are clearly geared towards the consumer's personal requirements; goods that may perish quickly or goods whose sell-by-date would quickly run out,
• that are not suitable for returns for reasons involving health protection or hygiene if their seal has been broken post-delivery,
• that were post-delivery inseparably mixed with other goods, • the supply of audio or video recordings or computer software which have been opened by a consumer;
• the supply of newspapers, periodicals and magazines (including books and charts).
Guarantee and liability
The statutory guarantee provisions apply.
Payment methods and credit notes
Payment for goods is to be made by Credit card via Barion or Paypal.
Online bank card payments are executed via the Barion system. The merchant does not get and store bank card data. Barion Payment Inc., the provider of this service, is an institution under the authority of the Central Bank of Hungary, its license number is: H-EN-I-1064/2013.

In case of this payment method, we are routing the buyer into the PayPal system. There they can use their Credit card, or an already existing PayPal account. The card credentials must be given on the PayPal's website at all times, so they are not seen by the retailer. Accepted credit cards: Visa (some of the Electron cards) EC/MC embossed cards.
Unfortunately, we cannot accept payment sent in the form of cash or cheques and are not responsible for loss.
Your credit or debit card will not be charged until your goods leave our warehouse. In the case of possible returns the amount paid will be refunded. Should your credit card have insufficient credit we reserve the right to invoice you for the costs incurred in making requests for payment.

Final provision
Should any provision of these Terms and Conditions be or become invalid or unenforceable, the validity or enforceability of the other provisions of these Terms and Conditions shall not be affected thereby. Hungarian law applies by way of exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG).

Processing purposes and nature of the data processed
The data entered by the user through the Website will be processed for the following purposes:
• to enable registering to the Website and to access the services reserved to registered users, as well as to comply with all the accounting-administrative and legal activities connected to it ("Registering");
• in the instance of an online purchase ("Sale"):
» to enable concluding the sale contract and the correct execution of the operations connected to it
» for the fulfillment of fiscal and legal obligations
• subject to the user’s approval, in order to send information about promotions, discounts, benefits on behalf of the Contractor, as well to send commercial information or news ("Newsletter"), to carry out market researches also meant to assess user satisfaction (Customer Satisfaction) and to report all the initiatives concerning products and/or services under the Contractor brand and/or from third parties, including the products sold in the www.barbaralcreations.eu website, as well as in the sale points of the Contractor, by means of automatized systems, such as emails or text messages ("Marketing");
• subject to the user’s approval, in order to analyze his selections as a consumer and his shopping habits ("Profiling"), on behalf of the Contractor by detecting the typology and frequency of the online purchases and, if listed, the areas of specific interest, optionally requested and selected by the user in the log-in form, in order to send information and/or advertising material that the user can find interesting, following the modalities decribed in the previous paragraph ("Profiling").
- Sensitive data
Sensitive data are never required to register in the Website and to shop online.
- Browsing data
The Website can be accessed and the products can be visualized without supplying any personal data. However, the IT systems and the software operating the Website normally do acquire some personal data, whose forwarding is implied in the use of the communication protocols of the Internet. Such information are not collected to be associated with identied users, but, by their own very nature, could, through elaborations and associations, allow users to be identified. This category of data includes IP addresses or domain names of computers used by users who access the Website, the Url addresses if requested resources, the time of request, the method used to submit the request to the server, the size of the file obtained in reply and so on. Payment management services allow to process payments with credit card, bank transfers and other payment procedures. The payment data used are acquired directly from the selected payment service provider and are never processed by the Website in any case. Some of these services may also provide for the programmed delivery of messages and/or emails containing invoices or notifications concerning the payment.
When paying with credit card, the user must enter his card information (card number, name on card, expiry date and CVV) directly in a webpage that will communicate with the payment service provider via a secure encryption protocol and the payment service provider will thus act as an independent data controller. Data are acquired in an encrypted format and in compliance with the security requirements seth forth by the PCI standard.
The payment services operates using the SSL (Secure Sockets Layer) Protocol.

Personal Data are collected for the following purposes and by using the following services:
» Contact form: by filling out the contact form with your own data, you authorize their use to reply to any information or quotation request as well as to any other kind of requested listed in the form.

» Commenting the Contents: commenting services enable users to post their comments on the contents of the Website. Disclosure of data and consequences of failure to allow data processing
The provision of the data for the purposes reported in article 1 is absolutely optional. However, since that processing is necessary to allow registering to the Website and being displayed the reserved services, including the e-commerce service, your refusal to supply the data requested makes it impossible for you to register to the Website and to shop online. In relation to the purposes of the processing listed in previous article, allowing to process your data is absolutely optional and can be expressed by simply selecting the related check box, for each different purpose, at the bottom of the Website registration form. Data processing methods
Data processing wil be carried out mainly with electronic and/or automated instruments, with the proper modalities and means guaranteeing the security and confidentiality of the data themselves and in compliance with Privacy Regulations. In particular, the Contractor will adopt all technical, IT, organizational, logistical and procedural safety measures, so as to guarantee the minimum level of protection of personal data as provided for by the law, enabling the access exclusively to the people in charge of data treatment on behalf of each Data Controller or of the responsibles designated by each Data Controller. Moreover, data will be managed and protected in environments whose access is steadily under control.
Area of data communication
The personal data supplied by the uses for the purposes described in the preceding article 1 can be communicated to the following subjects:
• employees and/or collaborators of the Contractor, as per the General Contract Conditions;
• companies or consultants in charge of installing, servicing, updating and generally managing the Contractor’s hardware and software, as per the General Contract Conditions;
• companies appointed by the Contractor to send online communications;
• all the public and/or private subjects, individual and/or corporate entities (law firms, accounting and tax advice companies), in case it is needed to forward the data or resulting as functional to the correct fulfillment of undertaken contractual and legal obligations, in relation to the services provided through the Website;
• the company in charge of carrying out telephone customer support (customer care);
• the subjects in charge of repairing the products purchased in accordance with the execution of the terms provided for by the legal guarantee of conformity;
• carriers and any subject in charge of delivering and/or picking up the products purchased;
• any subject (including Public Authorities) who can access the data, following regulatory or administrative provisions.

Right of access to personal data
As required by the applicable law regulations, the user has the right:
